BUSINESS CLASS FLYAWAY EXPERIENCE TO FASHION CITIES LUCKY DRAW PROMOTION 2018 TERMS AND CONDITIONS (“PROMOTION”)

Definitions

  • "Account" means a personal Singapore issued Maybank Credit and/or Debit Card account maintained by the Maybank Cardmember which has not been terminated and in the sole discretion of Maybank is in good standing.
  • "Chance" means one opportunity to win a Draw.
  • "Draw" means all or any one of the lucky draws as set out in Clause 3 a) herein to be conducted by Maybank in accordance with these terms and conditions.
  • "Maybank" means Malayan Banking Berhad, Singapore branch.
  • "Maybank Cardmember" means a person who is a principal Cardmember to whom Maybank has issued a Maybank Credit and/or Debit Card.
  • "Prize" means one (1) pair of return Business Class tickets to Milan, Paris or London, depending on the qualifying period.
    a) There will be three (3) Prizes to be given away in this Promotion where three (3) Winners will be randomly selected for each Prize.
    b) Each eligible Maybank Cardmember may only win one (1) Prize, and any subsequent drawings of the same Maybank Cardmember will be disregarded.
    c) The use of the Prize is also subject to such other terms and conditions as may be imposed by the respective merchant(s) supplying the Prize.
    d) Any additional requirements or extension of length of stay arising to extra cost aside from the Prize will have to be borne with The Winner.
    e) Maybank is not liable for any refunds or exchanges in the event the winner is unable to travel due to rejected travel visa or other reasons.

  • Retail Transaction" means an approved retail payment made by the Maybank Cardmember using his/her Maybank Card. A Retail Transaction includes monthly instalment amounts posted to a Maybank Cardmember’s Account during the qualifying period under a 0% instalment plan, but shall exclude the full amount charged under the plan. Cash advances, fund transfers, reversals, money transfers, annual fees, finance charges, EZ-Link, Transitlink, AXS and SAM payments and any form of online payment gateway transactions such as Paypal, BidPay, Skrill and gambling transactions are also excluded and will not be taken into consideration for the purpose of the Draw.
  • "Winner" means the Maybank Cardmember who is the winner of the Draw.

Definitions importing the singular shall include the plural and vice versa.

1. Eligibility
a) All Maybank Cardmembers whose Accounts are open and in good standing during the Qualifying Period are eligible to participate in the Draw except for:
i. Holders of Business Cards, Prepaid Cards and ATM Cards;
ii. Supplementary Cardmembers. For avoidance of doubt, the benefit of all charges incurred by a Supplementary Cardmember in respect of the Draw shall accrue to the eligible Maybank Cardmember. Termination of a Supplementary Cardmember’s account will not by itself disqualify the eligible Maybank Cardmember from the Draw;
iii. Maybank employees (and their immediate families) and employees of its advertising agencies or sponsors;
iv. Maybank Cardmembers whose Accounts are terminated between 11 April and 10 July 2018 (both dates inclusive);
v. Any other accounts that are deemed to be delinquent or unsatisfactorily conducted by Maybank at its sole and absolute discretion.
b) To be eligible for the Draw, the eligible Maybank Cardmember must send an SMS to Maybank after they have charged the required amount to their Maybank Card. If Maybank receives an eligible SMS in the correct format within the Qualifying Period, the Maybank Cardmember will receive an auto-reply SMS from Maybank. Maybank will not consider any SMS sent in the wrong format, or any SMS with incorrect details. Proof of sending an SMS does not constitute proof of Maybank’s receipt of the SMS.
c) Proof of charge slips is not proof of eligible spending. Card transactions as reflected in the monthly Statement of Account shall constitute proof of eligible spending for purposes of the Draw.
d) By participating in the Promotion and Draw and/or by accepting a Prize, participants agree to abide by the terms and conditions stated herein.

2. Awarding of Chances
During the Qualifying Period, each eligible Maybank Cardmember will receive the Chances as set out below:
a) One (1) Chance to win the corresponding Draw as stated in Clause 3 a) will be awarded for every S$10 accumulated in eligible Retail Transactions posted to the Maybank Cardmember’s Account and his/her supplementary Cardmember’s account (if any) during the relevant Qualifying Period. The Chances will be awarded to the Maybank Principal Cardmember only.
b) One thousand (1000) bonus chances (“Bonus Chances”) to win the corresponding Draw as stated in Clause 3 a) for every S$1,000 accumulated in eligible Retail Transactions posted to the Maybank Cardmember’s Account and his/her supplementary Cardmember’s account (if any) during the relevant Qualifying Period. The Bonus Chances will be awarded to the Maybank Principal Cardmember only and are additional to the Chances awarded in Clause 2 a).
c) Only Retail Transactions posted to the Maybank Cardmember’s monthly Statement of Account shall constitute proof of eligible spending for purposes of the Draw. Retail Transactions must be posted to the Account 5 working days after the end of each qualifying period.
d) Maybank shall not be responsible for any failure or delay in the transmission of evidence of Retail Transactions by merchant establishments, postal or telecommunication authorities or any other party which may result in a charge incurred by the eligible Maybank Cardmember and/or his/her supplementary Credit Cardmember(s) as being omitted from the allocation of Draw chances by Maybank during the Qualifying Period.
e) Chances accumulated are not transferable and will be cancelled by Maybank, without incurring any liability, upon the suspension, cancellation and/or termination of any Account.
f) Chances cannot be transferred to or combined with Chances awarded to any other Maybank Cardmember’s Account.
g) In the event that an Account is closed and a new Account is opened, Chances from the closed Account will not be transferred to the new Account.
h) For Retail Transactions for which Chances are awarded and are subsequently cancelled or reversed, Chances awarded will be automatically deducted.
i) Maybank reserves the right at any time to withdraw, cancel or invalidate the number of Chances assigned to any Account without notice or reason.
j) Maybank’s transaction records and the total number of Chances allocated to a Maybank Cardmember shall be final and conclusive. No correspondence will be entertained.

3. Draw
a) The Draw will be conducted on below dates or such other date(s) as Maybank may determine at its sole discretion at Maybank Tower 2 Battery Road, Level 1, Singapore 049907 or such other venue as may be determined by Maybank via a manual draw.

Qualifying Period: 11 June 2018 – 10 July 2018; Prize: 1 pair of business class tickets to London; Draw Date: 6 August 2018; Travel Period: 1 September 2018 to 28 February 2019

b) The Prizes will only be awarded to the respective Winners. Each Maybank Cardmember may only win one (1) Prize.
c) Maybank reserves the right to draw a reserve winner to substitute a Winner if subsequently found to be disqualified. Maybank’s determination of the Winners shall be final, conclusive and binding. No correspondence or claims will be entertained.
d) Winners will be notified by ordinary post and/or contacted via telephone at his/her last known contact on record with Maybank. Except for notifications to the Winners, Maybank is not obliged to enter into any correspondence with any person on any matter concerning the Draw.
e) Results will be announced on Maybank’s website at www.maybank2u.com.sg within seven (7) working days after each Draw and published in a newspaper within fourteen (14) working days after the last Draw has been concluded.
f) Maybank reserves the right to claim the full cost of the Prize from any Winner in the event that: a) an eligible card Retail Transaction is cancelled or reversed (in full or in part) after the Prize has been awarded; b) the Winner’s Account is closed/terminated for whatever reason (whether by the Winner, Maybank or otherwise) within six (6) months from the date the Winner receives the Prize; and/or c) it is determined by Maybank that the Winner has breached one of the terms stated herein. In such cases, the Winner authorizes Maybank to debit his/her Account for the full cost of the Prize prior to the closure or termination of his/her Account and/or deduct from any other account the Winner holds with Maybank.
g) The terms and conditions of the merchant(s) providing the Prizes shall also apply to the Winners. h) Prizes must be claimed in Singapore within twenty-one (21) working days after the Draw date. Any unclaimed Prize will be forfeited. Any Winner whose Prize has been forfeited shall not be entitled to any payment or compensation notwithstanding non-receipt of notification.
i) Winners must be available to travel within the travel period stipulated by Maybank and the merchant (“Travel Dates”) and booking of the Business Class tickets must be concluded within one (1) month from the date such Maybank Cardmember acknowledges that he/she is the Winner of the Prize (the “Booking Period”). Preferred dates are subject to availability by the merchant. If a Winner is not able to travel within the relevant Travel Dates or if a Winner fails to book the Business Class tickets within the Booking Period, such Winner will be disqualified and no extension of travel dates or the Booking Period is permitted. In this situation, Maybank reserves the right to transfer the prize to the next selected reserve winner.
j) The Prize is neither transferable nor exchangeable for cash, credit or otherwise. Maybank may, at any time without notice in its sole and absolute discretion, substitute the Prize with another prize of similar value without notice and liability to any person. After a Prize has been claimed, Maybank will not replace the Prize with another item/prize in the event of no-show by the Winner.
k) Failure to be granted the required travel visa for any reason whatsoever will result in the Winner’s disqualification. Maybank does not guarantee the approval of the Winners’ travel visa applications and Maybank shall not be responsible or liable if a Winner’s travel visa application is refused or rejected for any reason whatsoever. In this situation, awarding of a reserve winner is at Maybank’s absolute discretion.
l) A Winner is not entitled to any payment or compensation from Maybank should the Winner be disqualified or the Prize be forfeited for whatever reason.
m) Maybank reserves the right to transfer the Prize to the next selected reserve winner in the event that Maybank is unable to contact a Winner within three (3) days from the relevant Draw date or if the Cardmember is unable to fulfil the obligations required of him/her.
n) Maybank shall not be responsible for any other consequences including but not limited to loss of life, injury to person and/or damage to property arising from or in connection with this Promotion, the Draw and/or redemption or use of the Prize, lost, late, misdirected, damaged, incomplete, illegible or postage-due mail, or transactions that are processed late, incorrectly or lost due to computer or other electronic breakdown or malfunction or any other reason.
o) The Winners shall accept the Prize “as is”. Extension of travel or change of dates or any part of the Prize will not be permitted. Maybank makes no representation or warranty whatsoever as to the quality or fitness for purpose or any other implied terms or conditions with respect to the Prizes. Maybank assumes no responsibility or liability for the acts or defaults of the merchant(s), or for any delay, postponement, non-delivery, non-performance or defects in the Prizes. Maybank is not an agent of the merchant supplying the Prizes. Any dispute about the quality or performance of the Prizes must be resolved directly with the merchant.

4. General
a) Maybank Cardmembers hereby authorise Maybank to disclose and publish their names and other particulars in accordance with applicable law, in the event that he/she wins the Prize.
b) If applicable, the Winner consents to attend a Prize presentation and/or participate in publicity programmes. All expenses and/or costs incurred for such attendance shall be borne by the Winner and Maybank reserves the right to use the name, address, photographs, information, particulars and/or documents of the Winner in any advertisement or other forms of publicity from time to time.
c) Maybank shall have the sole and absolute discretion to exclude any person from participating in the Draw without any obligation to furnish any notice and/or reason.
d) Maybank reserves the right in its sole and absolute discretion to vary, delete or add to any of these terms and conditions from time to time or terminate the Draw at any time without notice or liability to any person.
e) Maybank, its related corporations, employees and/or independent contractors shall not be liable to any person for any loss, damage and/or injury whatsoever or howsoever caused arising from this Promotion, the Draw or the use of the Prize.
f) Maybank’s decision on all matters relating to the Draw (including without limitation the Chances awarded to the Maybank Cardmembers and the selection of the Winner of the Draw) shall be final and binding on all participants.
g) Maybank may at any time waive either unconditionally or on such terms and conditions as the Maybank deems fit in its discretion any right it has under these terms and conditions; however, any such waiver shall not preclude Maybank from exercising such rights in the future.
h) In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the promotion, these terms and conditions shall prevail. All images of the Prize on any collateral shall be for illustration purposes only.
i) These terms and conditions shall be governed by the laws of Singapore and the participants of the Draw irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.
j) A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions.
k) The prevailing terms and conditions governing Maybank Credit Card and Debit Card Agreement shall apply.

  • Luggage Loss
    If your checked-in luggage is not delivered to you within 48 hours of your arrival at your scheduled destination point, it will be assumed to be permanently lost. You and your insured family members may claim up to S$1,000 for purchases of essential requisites and clothing charged to your Maybank Credit Card as a result of such loss, within 96 hours of your arrival at your scheduled destination.
  • Repatriation of Mortal Remains
    In the event of the death of an Insured Person whilst on a covered trip, insurers will pay up to an amount of S$5,000 per person in respect of the costs for the Repatriation of the Mortal Remains of the deceased to the location selected by the Insured Person's legal representatives.

    Benefit is payable if:
    • Death benefit is payable (ie event is covered under the policy)
    • Death occurs whilst on covered trip. No cover if Assured returned home but died subsequently due to complications of the accident
    • Subject to the actual cost incurred.
